The MTS web site consists of various web sites and web pages (collectively, the "MTS web sites") operated by MTS Health Supplies, Inc. and/or its affiliates (collectively, "MTS").

The MTS web sites are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the MTS web sites constitutes your agreement to all such terms, conditions, and notices. Your use of a particular MTS web site included within the MTS web sites may also be subject to additional terms outlined elsewhere in this agreement (the "Additional Terms").

Additionally, the MTS web sites may themselves contain additional terms that govern particular features or offers (for example, chat areas).

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular MTS web site, then the terms, conditions, and notices contained herein shall control........

Return Goods Policy 

Subject to applicable law, Seller will process returned goods for Products purchased from Seller, in accordance with its then standard Return Goods Policy. Seller’s current Return Good Policy is as follows:

( 1 ) All requests for return of Products must be pre-approved by Seller’s customer service department. Not all items are returnable. Some items may require additional restocking fees. A credit will not be issued for items returned without pre-approval.

( 2 ) All returned Products must be: (i) returnable to Supplier; (ii) in the original unopened packaging; and (iii) in resalable condition, unless such Products are not in original unopened packaging or resalable condition due to the fault of seller.

( 3 ) The amount of credit on any given return, as described below, will be issued no later than thirty(30) days after the receipt of the merchandise and necessary documentation and the examination and inspection of such return at the local Seller distribution center.

( 4 ) Product that are: (a) special order Products; (b) Custom Products; or (c) products not available for general or unrestricted distribution are not returnable.

( 5 ) Products shipped in error by Seller and nonconforming Products – FULL CREDIT – if returned within thirty (30) days of date of invoice.

( 6 ) Products shipped in error by Seller and nonconforming Products not returned within thirty (30) days are not returnable.

( 7 ) Products shipped that are damaged or do not meet Seller standard quality – FULL CREDIT – if returned within thirty (30) days of date of invoice.

( 8 ) Products shipped that are damaged or do not meet Seller’s standard quality not returned within ninety (90) days of invoice are not returnable.

( 9 ) Locally stocked Products returned within thirty (30) days of date of invoice – FULL CREDIT.

(10) Locally stocked Products returned after thirty (30) days of date of invoice – 15% RESTOCKING CHARGE.

(11) Non-locally stocked Products that are returned within thirty (30) days of date of invoice - 15% RESTOCKING CHARGE (plus any additional costs incurred in returning such Products to the Supplier).

(12) Non-locally stocked Products that are not returned within thirty (30) days of date of invoice are not returnable.

(13) Returned items that require a pedigree under applicable law, such as prescription drugs must be accompanied by the appropriate signed declaration from Buyer..

(14) Notwithstanding anything above to the contrary, Buyer shall receive FULL CREDIT on any Products returned as the result of a recall or defective condition. 

(15) Non-Returnable Merchandise:

  - Products returned without a Return Merchandise Authorization (RMA) number.
  - Hazardous materials.
  - Custom items.
  - Special orders.  
  - Refrigerated or frozen products. 
  - Expired products.
  - Products not in their sealed, original packaging.
  - Products damaged, defaced or altered in any way.
  - Items dropped-shipped from the manufacturer.

 

PAYMENT TERMS

We offer Convenient Payment Terms

• PAYMENT METHODS: For your convenience, we provide several payment alternatives. We accept most major credit cards. Please have your credit card number ready when placing your order. MTS accepts ACH debit as a form of payment which allows for electronic transfer of funds directly from your checking account. In addition, for qualifying customers, any order can be billed to your account. All invoices are payable within 30 days
• OPEN ACCOUNTS RECEIVABLE: All unpaid accounts receivable past 30 days are subject to a 1.5% finance charge per month.

MEMBER ACCOUNT, PASSWORD, AND SECURITY

If a particular MTS web site requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You then must choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account and restricting access to your computer. Furthermore, you are entirely responsible for any and all activities that occur under your account or password. You agree to notify MTS immediately of any unauthorized use of your account or any other breach of security. MTS will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. Additionally, you could be held liable for losses incurred by MTS or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the expressed permission of the account holder.

MODIFICATION OF THESE TERMS OF USE

MTS reserves the right to change the terms, conditions, and notices under which the MTS web sites are offered, including but not limited to the charges associated with the use of the MTS web sites. You are responsible for regularly reviewing these terms and conditions and additional terms posted on particular MTS web sites. Your continued use of the MTS web sites constitutes your agreement to all such terms, conditions, and notices.

PERSONAL AND NON-COMMERCIAL USE LIMITATION

Unless otherwise specified, the MTS web sites are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the MTS web sites.

LINKS TO THIRD PARTY SITES

The MTS web sites may contain links to third party web sites ("Linked Sites"). The Linked Sites are not under the control of MTS and MTS is not responsible for the contents of or products or services from any Linked Site, including without limitation any link contained in a Linked Site or any changes or updates to a Linked Site. MTS is not responsible for webcasting or any other form of transmission received from any Linked Site nor is MTS responsible if the Linked Site is not working appropriately. MTS is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by MTS of the Linked Site or any association with its operators. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the Linked Sites.

Any dealings with third parties included within the MTS web sites or participation in promotions, including without limitation, the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the third party. MTS shall not be responsible or liable for any part of any such dealings or promotions.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the MTS web sites, you will not use the MTS web sites for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the MTS web sites in any manner which could damage, disable, overburden, or impair any MTS web site (or the network(s) connected to any MTS web site) or interfere with any other party's use and enjoyment of any MTS web site. You may not attempt to gain unauthorized access to any MTS web site, other accounts, computer systems or networks connected to any MTS web site, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the MTS web site.

USE OF SERVICES

The MTS web sites may contain e-mail services, chat areas, message services and/or other message or communication facilities designed to enable you to communicate with others (collectively, the "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Use the Communication Service in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.

Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another or any of the MTS web sites or networks connected thereto.

Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.

Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
